Land transfer deal in Berwick car park is poised to proceed
Berwick Town Council has admitted defeat in its objection to a proposed land transfer.
It is in relation to a parcel of land in the corner of the Coxon’s Lane car park.
In the autumn, Northumberland County Council requested views on the removal of a restrictive covenant from the small area to the rear of 11 Wallace Green so it could be transferred to the new owners and to allow them a small garden.
The town council wanted a share of the capital receipt and transfer of the freehold.
But the Lands Chamber of the Upper Tribunal has ruled the town council has no entitlement because it isnot mentioned in the 1993 covenant.
